Also considered ancillary or accessorial to the manufacturing, selling or leasing process or business shall be the use or operation of computers, computer servers, and similar electronic devices, hardware and software, and all gambling records, data or information owned, maintained or stored thereupon, or produced, generated, created, printed, transported or transmitted therefrom, whether paper, electronic or otherwise, in conjunction with legal gambling and in compliance with the laws of the United States.
Ancillary or accessorial uses shall not include use of the gambling devices or records that would allow persons physically present in the state of Tennessee to place gambling bets. This subdivision a 5 shall not apply unless the manufacturer meets or exceeds federal government requirements pursuant to 15 U.
Section et seq. Additionally, the manufacturer shall provide the secretary of state with proof of annual registration under 15 U.
Section with the office of the United States Attorney General within thirty 30 days of the receipt thereof. If the district attorney general or law enforcement agency does not believe that a gambling device or record should be destroyed in a particular case, the district attorney general shall petition the court for an alternate disposition of the record or device. If the court finds that the proposed alternate disposition reasonably ensures that the device will not be used in an unlawful manner in this state, the court may grant the petition and order the disposition of the device or record in accordance with the petition.
North Carolina is one of the least gambling-friendly States in terms of legislation. What little gambling there is takes place in one big casino on Tribal land. All that remains outside of the reservation is a little charity gaming, a lottery and some very low-stakes bingo games.
Anyone hoping for improvements will probably be disappointed — the track record of this State is one of progressive crack-downs on all forms of gambling, rather than progressive liberalization of their gambling laws. First below, I have covered the rich history of gambling crack-downs in this State, in quick-fire fashion. Things get more detailed after that, with the key passage on gambling from the North Carolina Statutes, plus a legal timeline of changes to the gambling laws.
When this did not work out they went the taxation route instead, targeting playing cards and gaming tables. Eventually, all forms of gambling were simply made illegal. Interestingly the North Carolina laws do not distinguish between organizers of games and players. Currently, both would be put on misdemeanor charges for their first offenses. Bingo takes several forms, including a high-stakes bingo parlor on Cherokee Indian land. This got a big boost in , when a second compact was negotiated allowing table games to be added. This is currently the only legal gambling venue in the entire State.
Yes, there is one tribal casino, which is run on native land by the Eastern Tribe of Cherokee Indians. No, there is nothing in the laws which explicitly outlaw internet games, however, as in other States , existing gambling laws are assumed to cover this area. Yes, though only in the native casino. No, it is not thought that this State are in any hurry to join the list of States offering legal poker games given their general anti-gambling stance.
